Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BuddyBird mobile application (the “Service”), provided by Buddybird (“we,” “us,” or “our”). Please read them carefully. By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

BuddyBird is a mobile application for people who keep parrots, providing the following features:

  1. Assistance with teaching parrots words (language learning support)
  2. Assistance with parrot care and record-keeping
  3. Other features we may provide

We may change, add, or remove features of the Service at any time.


2. Eligibility & General Audience

The Service is intended for a general audience, primarily adults who keep parrots, and is not directed to children under 13. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you can form a legally binding contract, or that you are using it under the supervision of a parent or legal guardian who agrees to these Terms.


3. Use of the Service & License

  1. The Service is provided as a mobile app. It is currently available without account registration.
  2. You may use the Service only after agreeing to these Terms.
  3. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Service for your own personal, non-commercial purposes.

4. User Obligations

You agree not to:

  1. Interfere with or disrupt the operation of the Service;
  2. Use the app in an abnormal or unintended manner;
  3. Copy, modify, or distribute the app without authorization;
  4. Use the Service in violation of applicable law or public order and morals.

5. Intellectual Property

All copyrights and intellectual property rights in the Service and the content provided within the app belong to us. You may not copy, distribute, or commercially exploit them without our prior consent.


6. Changes to & Interruption of the Service

  1. We may change or discontinue part or all of the Service as needed for improvement or operational reasons.
  2. Provision of the Service may be temporarily limited due to system maintenance, failures, or other causes.

7. Third-Party Services & App Stores

The Service uses third-party services (for example, Google Firebase and Microsoft Clarity for analytics and diagnostics), and your use of those features may be subject to the applicable third-party terms.

The Service is distributed through the Apple App Store and Google Play. Your download and use of the Service is also subject to the applicable app store’s terms.

If you obtained the Service through the Apple App Store, you acknowledge that these Terms are between you and us only, not with Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide any maintenance or support for the Service. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Service, and any claims relating to the Service (including product liability, legal or regulatory non-compliance, and consumer protection claims) are our responsibility, not Apple’s. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.


8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

The Service provides reference and educational features only and is not a substitute for professional veterinary or animal-care advice. You are solely responsible for the actual care of your pet, and we are not responsible for the results of your pet care.

We are not responsible for service disruptions caused by force majeure, network failures, system errors, or other causes beyond our reasonable control, nor for problems arising from your device or communications environment.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US TO USE THE SERVICE (IF ANY) OR USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.


10. Indemnification

You agree to indemnify and hold harmless Buddybird and its officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Service or your violation of these Terms or applicable law.


11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or as needed to operate the Service. You may stop using the Service at any time by uninstalling the app. Provisions that by their nature should survive termination (including Sections 5, 8, 9, 10, 12, and 13) will survive.


12. Dispute Resolution

If you have a concern or dispute, please first contact us at joynnovate@gmail.com so that we can try to resolve it informally. We will make good-faith efforts to resolve any dispute within 30 days of receiving your notice.

If we cannot resolve the dispute informally, it will be handled through the courts and under the law identified in Section 13 (Governing Law), except where the mandatory law of your place of residence provides otherwise.


13. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-law principles, and any dispute not resolved under Section 12 will be subject to the courts of the Republic of Korea. This does not limit any mandatory consumer-protection rights available to you under the law of your state or country of residence, nor deprive you of the protection of the mandatory law of the place where you live.


14. Changes to These Terms

We may modify these Terms to the extent permitted by applicable law. When we do, we will provide notice through in-app announcements or by posting the updated Terms. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.


15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms constitute the entire agreement between you and us regarding the Service.
